Date Announce for Autumn Legal Update Masterclass
This Masterclass for the Right to Build Task Force by James Corbet Burcher (No5 Chambers) will provide a legal update on 2 areas:
Section 123 Levelling-Up and Regeneration Act 2023 changes
The masterclass will examine how the changes under Section 123 LURA are already having a significant impact on the self-build and custom-build sector, including a survey of key appeal decisions since 31 January 2024
In particular, the masterclass will examine how appeal decisions have approached (i) the calculation of unmet demand figures; (ii) the assessment of historic development permissions; (iii) ensuring that current/future applications meet the definition of self-build and custom-build; and (iv) the question of weight where there is an unmet demand/deficit.
New policy and Legislation in 2025
The masterclass will then consider the proposed changes to the NPPF and potential new secondary legislation under the LURA in 2025
